The problem is the site couldn't fund itself. It isn't that Jacob isn't allowing lolicon on Fakku as a personal choice. He doesn't allow lolicon on Fakku because it is forbidden by Black Label Ads, which is the ad revenue service that Fakku uses. Bottom line is, Fakku is kept running primarily by the money that is generated through the ads.
It's not worth ignoring Black Label's Terms of Service just so lolicon could be on the site, when instead it would more likely turn out that Fakku wouldn't exist in the same capacity anymore because it wouldn't generate any revenue because Black Label would drop Fakku.
And Jacob would be hard pressed to find an adult ad revenue company that allows the depiction of underage pornography because that is defined as "obscene" in the United States, and is against the policy of almost all ad revenue companies, even adult ones such as Black Label.
About the only way we're going to see lolicon and Fakku together is if someone were to make a huge donation to where Fakku could run by itself without the need of ad revenue.

Sort of. Wordpress users are affected. I can guarantee that Wordpress' Terms of Service also has something in there about no site using their service should contain material that is obscene. The point is that Wordpress is a lot less likely to care.
Essentially you'd have to build your site from scratch and fund it entirely by yourself to worry about little to no repercussion.
It's all a matter of how much risk are you willing to take? How much good will are you willing to bank on? Because bottom line, it is (at best) a touchy subject in the United States and any site regardless of how it is funded and who owns it, can be taken down for such material if someone tries hard enough.
The good thing is lolicon is still (sort of) protected by the First Amendment. However, that only applies if it passes the Miller Test. Well, it isn't likely to, but the actual steps necessary to take that to court, and prove or disprove its obscenity in any fashion is more of a hassle than almost anyone is willing to take. So, most everyone is just banking on that concept, for now.

there are other websites which have loli content, why not try using those? I don't understand why people press as hard as they do so that fakku has loli... If you're doing it for the site then you dont need to, if you're doing it for yourself there are other places so there is no need once again. Most of the staff enjoy loli, we dont want to have it removed, but realistically fakku is in essence a business which provides its services free of charge, and the money has to come from somewhere.
Let me put it to you this way, would you rather have fakku the way it is now, no lolis but free of charge, or would you rather pay a monthly subscription and have all the loli you can get elsewhere? Remember that we would need a majority of the users to support a subscription for this to even be considered.
