It's ALWAYS rape. It's just up to the woman to press charges or not. At least, that's how it is legally. That's how all sexual situations should be treated, because all it takes is one bitch's whim to put your ass in prison and your name on the sex-offense registry.

quite honestly, I doubt that happens IRL with enough frequency to be considered significantly.

It's not rape if you're trapped in a cave looking at the shadows of a bunch of puppets on the wall in front of you, but suddenly you're released and you see the light of the Sun of Truth and realize that the shadows were mere illusions and the real rape happens OUTSIDE of the cave. When you go back to tell your fellow prisoners in Plato's Cave of their plight and how they're believing in a false reality, but in furious disbelief they kill you. It's not rape then.
