About sending your hentai book in the mail.

Just posting to give some info but I hope you guys at fakku realize that the usps(united states postal service) can open any piece of mail that they find questionable and see if it violates their rules or any laws. If they think a drawn pattenko character is underage then they can give it to the police for child pornography and then the person receiving it will get in trouble etc.
Any shipping center in us seems to have the same rights to open packages. So I dunno what to suggest actually. :/
There was a court case of something similar happening where they opened up the mail of a guy who got loli hentai from japan in the mail. He was facing 25 to life in prison because of it last I heard. Also my cities postal workers are a bunch of bitches, they once personally drove over a piece of mail to my residence to charge me $5 extra and told me "by law we can open and confiscate any piece of mail we find suspicious" so they pretty much black mailed me in paying extra postage I don't think they deserved.
here's the link to the results of that court case: http://www.animenewsnetwork.com/news/2010-02-11/christopher-handley-sentenced-to-6-months-for-obscene-manga

First of all, that is pretty fucked up that the mail workers have supposedly the right to open anybodys mail at anytime if they so choose or find it somehow 'suspicious'. To me that doesn't make any sense and is an infringement of our privacy and of our rights.
Second of all, hentai being labeled as child porn is another fucked up thing. You have to proof that the girls or boys depicted in the manga actually are under 18. This bullshit notion that they look under 18 not only shouldn't be enough, but factually isn't enough. And i go even further than that. How in the fuck is drawing a picture same as child porn? Drawing or animating fantasy should never be illegal, it goes against basic human rights in my opinion. To me it is almost the same as controlling what you think or having rules as to what you are allowed to think, what you are allowed to fantasies about so on and so fort.
Thirdly i would like to say that if it is indeed the case that USP is checking our mails at their own will, i seriously suggest that you and me and everybody stops using that companies services anymore.

You know the guy only got 6 months and this article is nearly 5 years old; the case itself was settled in 2008?
I get why the UPS store did what they did, but to go so far with things as they did was a bit extreme.
A lot of people have spoken out against this issue, because at the end of the day the guy was just another nerdy otaku/comic book/game lover. There was no evidence that he owned any other form of pornography (all of it was drawn porn) or was a threat to society. They did a psych evaluation on him that proved he was no threat to society. Even his collection of what was considered "obscene content" wasn't very big (8 books I think) compared to the other 100s of works that were considered "appropriate". The case was handled very poorly and with a proper defense the outcome would have been different. If anything the worst they should have done was take away the contraband that the government didn't like and give him a slap on the wrist; not fair I know, but jailtime for what he did is a bit much.
Basically hentai is a grey zone in terms of legality for the United States. Some states are more harsh on their law of of underage such as New Jersey and Utah. The main thing is this, a lot of people do not understand hentai or manga/anime in general. They see nerdy people who are usually between their 20s-40s who watch highschool girls that look 10 or 10 year olds who are actually 1000s of years old flash their panties every other scene. I know in middleschool/highschool I got in a huge amount of trouble for having manga in the classroom after a test.... the asshole teacher shouted in front of the class, "you brought porn into the classroom!" Even the principle got involved, but luckily the librarian and my parents stepped in to help because this shit has been in the school for way longer then these two numbskulls had known.... btw the books I had was Fruits Basket and my poor reputation was ruined for months.
Anyways, the law is so poorly written for such works that with a good lawyer, this can be dismissed. The guy who got that sentence was actually a shame and probably didn't have a good jury selection/a good lawyer. I believe by reading more they tried to repeal the case a few times, but to no avail. Once the case was settled no one cared to go back and re-hash it out.
There have been a few other cases on hentai going to court. Usually what get's people convicted is the fact that some people will have actual child porn on their hardrives or they are moreso suspected of being child molesters. Cases have been thrown out when the only evidence given is drawn material, though as I said some states are more harsher then others.
There is not enough scientific evidence out there to prove that hentai/lolicon/shotacon can induce someone to rape others irl. Those who do were usually more sick even before they started reading the material and no true direct correlation can be proven without a doubt. As I said before, most cases are usually dropped or those charged get arrested because they had more then just hentai on their computers or sent to them via other means. Even if they did have people come in and decide what content is considered acceptable and banable, there is a huge infringement of rights since none of the content is real. There is more fucked up shit in the world then just hentai and why that isn't considered an offense is beyond me.

Isn't Fakku! Based in the states? Should be good, or else they wouldn't be able to distribute it in the first place.

This isn't Australia. Small breast=/=CP or a good portion of the us would be arrested for small tit porn stars or dating. Plus every case of lolicon arrested they had real child porn. I BOUGHT LOLICON THRU THE USPS MAIL SYSTEM MANY TIMES. Miller is truth. Plus CCPA was overturn. Yes lolicon was illegal once but now it up to state to find no artistic merit to the porn.

There is a whole group dedicated to defending people against this exact scenario, and like Freak said all those cases the person was found with actual child porn. Id be a bit more hesitant with what you buy that enters the country from international sources but if it looks adult nobody really cares, tons of porn gets shipped daily, but at the same time I try to avoid covers with loli, I'm also a very paranoid person though.

"here's the link to the results of that court case: http://www.animenewsnetwork.com/news/2010-02-11/christopher-handley-sentenced-to-6-months-for-obscene-manga[/quote]" he only got 6 months

to say someone only got 6 months is still a lot, it also makes it significantly harder for him to get any decent jobs, he also has his internet restricted and he is monitored for 5 years and has to go to brainwashing classes for 5 years till they can accept him as "normal"
So yea his sentence was obviously harsh, there was a 140 page long discussion about this on the forum, and nothing has really changed since then either. I was just thinking that there might be better shipping methods than people arbitrarily opening up your mail and decide to tell the cops to arrest you because of it.. But I guess there really isn't any better shipping method than usps where they'd need to get a warrant for it for some package. But only first class mail/packages. Ups and fedex don't need any warrants..

Is better then the supposed 25 years mentioned in your opening. Luckily he wasn't put on a sex offender list and he will get his rights back in due time, though I doubt he'll be buying anymore porn in the future because of this incident. Also keep in mind that this was an international shipment which are usually checked more carefully vs shipping within the US. It doesn't make it any less wrong, but it's the way our system works.
The biggest issue with this though was the fact that this case was put into motion and no one gave it a second thought. The defense seemed to pretty much give up on him and the prosecutors, judge and jury were all ready to say guilty at the drop of a hat even though evidence proved nothing. No actual child porn was found to be on his person and the psych eval showed no indications of current or future deviant behavior. If they wanted to take action they could've just confiscated his material that was considered illegal, made him pay a fine, and give him a stern warning not to do it again. Still would suck, but better then what he got.
Main lesson here is to be as careful as you can, but to know that the first amendment and a good lawyer will probably get the charges dismissed. It's rare for such cases to be taken this extremely unless they find other things to charge you on.

This is what's prohibiting Fakku from sending me books now that I am no longer residing in the US. Fortunately, I still have a US address so that I can redirect my mail here. The problem is that this means my books will spend more time traveling through the hands of postal workers--and we all know how well they treat packages labelled 'fragile'. I wonder if I will make headlines with my purchase =O

Reading this makes me curious about the laws of each State in the U.S regarding loli Hentai. I live in Virginia, am I safe if I order loli from Honto.JP for example?
Truly absurd that loli Hentai fans are put on the same level as child molesters still :\

Just put some wrap it in some sealed plastic bag, sandwich it between some midget gay magazine/book on top of it. They can not endure to look it that much and will seal it back. Create fake cover for the manga if necessary..

I'm gonna clear something up right now. I used to work for the USPS and there will never be any reason they will open your mail unless the OIG or the cops have reason to believe yourself in particular are receiving illegal materials.
I should say that this only applies to the US and once it leaves the country it's in different jurisdiction.
