A man was arrested after refusing to take a breathalizer test, instead farting in their direction, and said "Use that for your breathalizer test". He was arrested under charges of assaulting a police officer.

Hey, I'd totally abuse my ability to arrest people in that situation; I woulda tried to frame him for obstruction of justice and assaulting an officer.

Pfft, nice. This is why I hate the police. Last time I checked I have the right to insult the police service, up and down until I'm blue in the face, as long as I actually obey their bullshit.

one of my favorite cop related stories was from a time me and my friend Whitey got arrested for some alcahol related reason. we were being transported from the local police station to the main jail. it was pretty cold out, and the cop had the windows down in the front. i said,' hey man, can you roll up the window, it's hella cold back here'. cop response, 'you better ask right, boy'. to which i responded(oliver twist-ish), 'please sir, it's ever so cold. might you roll up the windows sir?'. cop/stooge answer, 'that's better', as he rolled up the windows. Whitey was laughing his ass off, and the cop totaly missed the point.

There are all kinds of twisted rules so, when you see someone charged for farting, it doesn't mean there's an even weirder case waiting out there. Still, that's pretty funny. Depending on your state you may or may not be allowed to refuse a breathalyzer. It's best to look up your states implied consent laws. Normally people sign this when they file for a drivers license. However, even if your state does have implied consent laws, you can generally still refuse field sobriety tests.
Be aware of the consequences of doing so. For example, in the state of Illinois, if you refuse a breath alcohol test when you are under suspicion of driving while intoxicated, your license is suspended for 180 days.
A tip on refusing a test. Politely yet, firmly decline a test by saying "not until I speak with an attorney".
Also keep your mouth shut if the cop trying to talk to you. Only follow what you need to do such as producing your license, registration,etc but, skip the idle chatter as the cop is simply trying to gather evidence against you.
Failing a FST looks worse for you than simple refusal. Best to let them *think* you're guilty rather than let them *know* you're guilty.
On topic; It's a stupid charge but, still attacking somebody with bodily fluids and gases is considered assault. Spit on someone and you can face attempted murder charges.

Thankfully I don't drink or drive. Will eventually start driving. Drinking has never really been my thing. But yeah, I definitely ought to check out how it is for the state I live in (New York), not that I think I'll need it.. but you never know.
