2 things.

1. The claim on konoka was in the first game. This is now the second, and since Hiroyuki did not re-claim her she is free to be claimed.

2. It seems you are saying she is to old to be claimed as a loli. However, in the rules, specifically rule 4. It says that you can claim any manga or anime character that has become a Loli in there series. And Konoka did become a loli by taking a pill in chapter 76 page 12 of the Negima series.
