The first who attempted were the Spanish which led to St. Augustine around 1565. The English did not successfully colonize a part of America until the 17th century which was Jamestown in 1607.
They are counted as American settlers and created the constitution, however they were inspired by men like John Locke(English) and Montesquieu(French I think).

Your thinking of the English system of autonomous states who governed themselves with the crown's permission. Not free independent counties but not part of the motherland. Aka Canada, Aussie prison, Anus island, Ireland and the other former territories of the UK. If the Queen of England is your head of state and you have a royal governor then are you really a nation?
