Well considering he wasn't driving either car, and the one that hit him and his friend the driver was on their cell phone...yeah I can see it somehow being his fault lol

As someone whose life was threatened by car more then once, I can say that this would be only his fault if he was:

- Crossing at a place that is not meant to be a crossing

- Crossing the road on red light.

Since Neo is (generally) actually a responsible guy, I doubt he would do either, so it's 99.9% drivers fault.
And if that driver ever runs from Canada to France, I will find him/her and rape them.
