It's worded terribly but basically what they want is that if you say for instance that "paypal is a sexy mofo, damn girl you fine". That they can post that on their social media and in the news without having to pay you for the right to be able to use it.

The wording used is absolutely terrible but this is a very prominent issue online. If you post on a forum for example, who owns the content posted? If I draw a piece of art for example, and I post it on the forums here, do I own that piece of art or does the creator of this website? If I say a bunch of hateful racist things and bully someone, who is responsible and held accountable, me or the creator of the website. It's a very large grey area and I think paypal is just trying to cover their own butts in some ways.

“When providing us with content or posting content (in each case for publication, whether on- or off-line) using the Services, you grant the PayPal Group a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable (through multiple tiers) right to exercise any and all copyright, publicity, trademarks, database rights and intellectual property rights you have in the content, in any media known now or in the future."

To sum this up, it says that if I give paypal a piece of art on the forums, or mail it to their office. They can use the use that piece of art without having to pay me because I gave it to them.


"Further, to the fullest extent permitted under applicable law, you waive your moral rights and promise not to assert such rights against the PayPal Group, its sublicensees or assignees. You represent and warrant that none of the following infringe any intellectual property right: your provision of content to us, your posting of content using the Services, and the PayPal Group’s use of such content (including of works derived from it) in connection with the Services.”

This just says that if we use the content you sent up if it's a forum post, feedback, customer service call, artwork, whatever you sent to paypal, that you won't sue the balls of them for using it.


Overall it's very poorly worded, but it's just saying that if you give them something they have the right to use it for whatever. Let's clear something up though, they are not saying that they have the right to sell any products that you might create. This is not saying that if you write a book and use paypal as your service for money that they get ownership of the book. They don't. They can not take your product and sell it themselves. But if you write a book and say "buy this book now, exclusively through paypal", they have the rights to advertise that your book is available to buy on paypal.
