Girl(10) Sues Her Father for causing Road Rage?

Kaitlyn Timko's father was driving her back to her mother's house after a visit with him when another driver shot him in the head during a road-rage dispute in Philadelphia. He slumped over the wheel and the car was bloodied as Kaitlyn sat in the back seat.
Neither the four bullets fired nor the flying glass struck the 9-year-old. But she was barely responsive when a counselor interviewed her that week, and her mother said she remains traumatized two years later.
Now Kaitlyn - through her mother - has sued her dad, charging that he set off a chain of events that led to the gunfire by cutting off the other driver.
Culleton(the Lawyer) represents Lori Hardwerk(the mother), 40, who filed suit on her daughter's behalf this year in Philadelphia Common Pleas Court. Hardwerk is seeking damages to pay for the intensive counseling she feels the 10-year-old needs to deal with post-traumatic stress.
The shooting left Thomas Timko(the father) with permanent brain injuries, a disfiguring scar and high medical debts. Shooter Christian Squillaciotti, a schizophrenic ex-Marine, is serving a 13- to 26-year prison term after being convicted of two counts of attempted murder and weapons charges.

I'll disown her right there and now -.-I don't believe the daughter is pulling the strings here. It seems more like the mom is trying to make the father's life a living hell.

Really though, although it paints a picture of a vindictive mother pulling the strings from behind the scenes in order to get some kind of judgment against her husband, we don't really get a clear picture of the situation. It isn't really fair to make a quick judgment that this is a worthless case without more information.
If the father was being entirely reckless, and the events so traumatizing to effectively incapacitate the daughter, then suddenly this court case becomes significantly more justified.
Let's take a page out of the Casey Anthony case and not jump to preliminary conclusions when we have no idea of the situation at hand, shall we?

Was talking about with a friend about this, he says it sounds like a custody issue, and fact that their last names no longer matches. So they're likely divorced, and the mother is capitalizing on the opportunity to get easy money from father and monopolize the daughter.

Dude got shot.. now brain damaged, probably unable to work or even function as a normal man should. I broke my hand when my brother girlfriends father charged at him with a pipe because he pop her cherry... should i sue my brother for that.. not the ass hole swing that shit is responsible. It's more reasonable to sue the asshole who shot the dad then a brain damage fool.

From what i understood from this situation was- the father and mother never married, had kids, still friendly. Father driving daughter to her mothers on free way. here is where it gets tricky.... the daughters/mothers case says that the father cuts a guy(the shooter) off and then proceeds to flick him off through the sun roof. guy gets angry then shoots dad 4 times. the fathers case says the father did nothing, was minding his own business when BAM, shot 4 time in the head. father manages to pull the car safely to the side of the road before going out of it.
the daughter is in the back seat when this all happens. no bullets or shards of glass hit the child. she was untouched, but traumatized. the daughter full of energy, now the complete opposite. this is why i believe why the father is being sued. for "causing" the traumatization.

Yes. I meant his specific issues not the broad range he could experience.Didn't give any specifics, just that it was serious and permanent. I was just trying to give a broad range what "maybe" his symptoms are.

Actually one may argue that it would be more effective for the daughter to file suit. She was the one that was traumatized, not the mother. It actually looks more conspicuous for the mother to sue on behalf of the daughter (outside of the necessity as guardian.)

What does the mother pay? I'm assuming nothing. it just doesn't seem fair. i guess life isn't fair.

I've seen this so many times. Mother hates father, something happens to the child while in father's or mother's care and some how mother sues father over it. Didn't some woman sue her ex a few months back for child support after they divorced and she got herself pregnant with the father's sperm left at a sperm bank? Why do the courts even take on bulshit cases like this?
