Under age characters illegal in USA?

Is hentai with characters under the age of 18 illegal and considered child porn in the united states? If so do they really ever charge anyone for it? Would you have to view the images or actually download them to your hard disk to get caught?

Dude, this topic is fucking everywhere on the site...
It doesn't warrant another to be made.
Question 1: Yes, its considered illegal.
Question 2: Yes, they do.
Question 3: It doesn't matter, you can be tracked either way.
Seriously, google can just tell you this, dude.

Is loli CP... yeah and no via the laws of the state of california, US and Miller... it cp because of it being drawed nude sex act with children in it, but the children are based or life like.. so it up to the court and your judge/jury if it arrestable loli or gray water loli. Of course their only been three cases so far on the new rules and laws of cp for loli...

^ Meh actually it isn't considered CP legally, only those that are found to be extremely heinous or without any artistic value, so generally all juries will vote against the defendant while judges generally have to let it go.Also who gives a fuck if it can be tracked, as it's not CP and generally in a null, grey area, they won't be searching for Loli and are not even searching, why search for non invasive "pedophiles" when you can divert resources and funding elsewhere.
Simply:Laws are for faggots. Most hentai deals with minors but who cares? Its too good.

Hum, I never heard such of a law. :P Maybe it's just because I'm located some where far that is actually part of U.S territory but just not enforcing it.
Cool to be in an island where they don't give a damn about child animated pornography.

If you have real, actual CP in your possession, too, when the cops find you, they'll likely include the loli as offending material just to add to the case.
But depending where you are, loli alone may not be enough. That said, this is very variable and changes quite often at police whim, it seems...

Not related to the topic, but iirc there was an incident in Canada where a guy had 1 (singular) cp image and lots of loli images and got around 5-10 years.

Lolicon/Shotacon is a huge gray area. The United States government has not explicitly covered the legality of the depiction of underage children. As it stands, the only legality pertaining to it is the Miller Test.
Which basically means that if it passes the Miller Test then that means the art is of expressive, artistic value, and not meant to be of an obscene nature. Well, unfortunately, lolicon is definitely obscene by legal definitions.
However, you won't find anyone in the United States being arrested for the possession of the depiction of underage children. It has only ever been, and probably continue to be for awhile, a tacked on charge related to a conviction for the possession of actual child pornography.

Life is too short to worry about that stuff is how I see it. If you love loli but spend your whole life avoiding it because you're afraid of being caught then it's controlling you. Living under constant paranoia is bad (seen this many times in psych patients).

yeah loli eligal but they cant arrest all of them since it would give the image of removing ones legal right to desire on its own

loli and shota are illegal if its obscene but ICE doesn't care about it because it doesn't involve real children. if you look at the Handley case you can see that they believe that its stupid to arrest someone for just having a drawing and also that the guy who look at Simpsons porn. he had that charge because he removed all the CP from his hard drive, he had jail bait porn, and he had pics form those "modeling" sites so they couldn't give charge him for those pics because they are technically legal. there was an article where a guy interviewed the lawyers in that case and they said that they are not going after people who look at obscene pictures and they charged him for obscene material. also if they were to arrested everyone who looked at hentai that had minors in then almost everyone on this site would be arrested because a lot of hentai has minors in it and it would be illegal.
P.S, they could also arrest people for reading Romeo and Juliet becuase she is fourteen and the movie American Pie because the characters are "teenagers" when they are actually in their early twenties

Just to increase on this point, you can go out to your local bookstore and purchase "Lolita" ,where the term for lolis and the occurrence of having a Lolita complex is derived,a book that revolves on the artistic rape and forced sexual actions committed on a child. While many may perceive it as CP, it is also believed to be one of the greatest literary works of the 20th century.Because of this you must understand, what makes art art is not reception or what one perceives, but what the person is found to hold in contempt when viewing the media.Art throughout history has lead to legal clashes but it has prevailed nonetheless. They cannot stop us from viewing this genre that stands near the verge of a disputed frontier.Know that there is a big difference from that which displays an act, and the act itself. One may portray death and battle with games of slaughter and arts of bloodshed, but even the majority cannot restrain itself from the glory it supposes, as such, there is no need to fret on the madness of those who say its illegal, hold strong your beliefs and they will never pose a threat to you.

I agree with you Darkhilt and that it is true that you should not worry about what others say about the art that you enjoy. a few people are against this form of art but there are many more of those who believe in free expression and that art shouldn't be censored because some people don't understand it. I don't enjoy loli but I don't want anyone to be arrested for just enjoying a form of art that some believe to be sick and morally wrong. I have friends that enjoy it and they not sick pedos. In the US we are becoming more open minded when it comes to art that has to deal with sensitive subject matter.
also Tsurayu, majority of lolicon material would not be considered obscene because if the that acts that were depicted happened in real life would be obscene because its causing harm to an actual minor. since loli is fiction and its not an actual minor so it would not be considered obscene because nobody is harmed but loli that had Beast, guro, rape, and other things like that would be obscene. If you were to look at Christopher Handley case, you would see that he had 80 mangas that had characters that appeared to be minors, and of those 80 only 20 were possibly obscene then only 7 were actually obscene.

actually they did pass a law for 8 months called the virtual child pornography law which would of made it illegal to watch , read or made anything with a adult actor playing a underage person in that movie or.. manga.. which that part doesn't matter. yeah American pie and romeo would of been cp by that standard.. overturn on a the fact.. the actor nude in those scene and the character portrayed in the manga and books are not real. Did my victimology 105 paper on the that law and the items included.. powerpoint with loli and hentai has my claim.. got an A- being a weeb in 2002.
