copyrights go to far

my blog got it by the dmca. i just found out. they told me all the posts that were taking down. after looking at all of them i found that i have the right to post all of it.

they don't have the right to take my stuff down.

half was doujinshi i have i posted. no one but the guy who drew it has the right. but they are found all over the web. they let the stuff be put up. so how does the dmca have any right to take it down. on top of this the rest of the posts were just me talking no downloads or anything. wtf. how do they hold the rights to my words.
all videos i posted can be found on this site. and this site does not allow copyrighted videos right so how. i did not post the copyrighted videos i have so why.

can anyone here help me understand this.

If you didn't produce the thing yourself, own the rights to it or get permission specifically from the creator. You aren't allowed to post doujin, images, movies, games, music, art,etc.

They just took it down, be thankful you didn't get slapped with a real punishment. The stuff doesn't belong to you. Never did.

like i said most of it was just my words nothing for download. so i dont have the rights to my words. so they can come after me i live in a free country.

But in seriousness, There's copyright, and there's copyright. It's fully natural to expect that when a person produces any thing that they and only they can stake their name to, be it music or porn or whatever, that they will kick your scrawny ass to defend it.

It's when we get into the realm of things like DRM that things start to get a little pissy.

Besides, on a annoyingly little legal technicality, Doujinshi themselves are an illegal representation of anothers work. Like Firey mentioned, with current legal conditions regarding Sharing...fuck, I'm still doing that...Piracy, be fucking glad all you got was a takedown notice.

listen. on youtube they was this guy i will not say his name. he is for evolution. he makes all his videos himself its his voice his art. he was hit for copyrights because someone who hates him filed a compliant. this ass was for creationism. anyways people abuse the dmca to get back at others. it happens all the time.

Truthfully, all the videos posted here on Fakku are posted illegally, I believe. Jacob just tries to keep people from posting videos that are copyrighted in America, because American companies are more likely to sue the American owner of the site or get the American owner thrown in jail. The Japanese companies that own the original copyrights tend not to make a lot of threats. At least, that's what I've gathered.

As for the DMCA getting rid of everything because of one infringement, it happens. When they see one blog entry or one video with copyrighted material, they can assume that all entries or videos have copyrighted material and delete all of them. That way, they don't have to go through a year's worth of entries or ten hours worth of video. It may not be right, but it makes sense. God knows I'd rather spend five minutes deleting everything than spend six hours going through everything and deleting 75% of it all.

Also, if I make a ten-minute video talking about how much I love The Simpsons, that's fine, but if I include a five-second clip of The Simpsons in that video, it can be removed. I'm pretty sure it's even illegal for me to cut out a picture of Homer Simpson and tape it to my shirt. Now, that's messed up, but that's the law, and it's completely understandable that they would remove anything breaking the law. It may not be right, but throwing someone in jail for smoking weed may not be right either, but I'm not going to walk down the street with a joint in my mouth.

even though i know it's illegal i still post copyrighted and licensed things all the time. it's for the enjoyment of other. but if they take it down, hellz yeah i'll be pissed, but i understand why and i get over it.

i just think they take shit to far.

if it was not for sites like this that post illegal videos i would have never found hentai or at lest knew it was this big.

hell all of my cds i buy i found by illegally downloading music from limewire.

its not fair but shit i know life is anything but fair. i am use to being screwed over.

but this is kind of a good thing. my blog was for people who are new to hentai. so i put up a email address for anyone to email me. i get around 600 Returning Visitors a week. on top over 3000 First Time Visitors a day. tons of emails. some asking for help that had nothing to do with hentai. some were pissed i did not upload what they like calling me a bitch. like i am at there beck and call. i think when i told some of them you fuck off that's when my posts were gone.

fuck one guy emailed me 15 times in one day. i was talking to him but he kept on emailing me over and over just asking were are you are you mad at me.fuck he lived in a different country. its 3am here when its only the afternoon were he is. so i wake up to emails. why are you not talking to me. why did you go to sleep.

shit one time he emailed me with my real name and address asking are you this guy that lives here. fuck Google maps gave him instructions to were i live. how he got this no fucking idea.

so i am kind of glad thank you dmca.

but my blog was getting big. i hardly put links up. so most were just telling there friends.

i even had a good name the church of hentai. took me along time to come up with a good one.

but in the end having a hentai site is to much a pain in the ass.

Please, don't tell them all to come to Fakku. This site has gained enough members lately, and it sounds like some of the people who visited your site are real assholes. Fakku doesn't need any of those. But if you talked to certain people, and they seemed cool, I think that'd be fine. Fakku is a great site; it just doesn't need people who threaten you and find you on Google Maps.

This i agree but i belive he is just meaning they take copyright to far.1 none of it was downloadable so it just stayed in one place he was not distributing it.2 all he had done with it was post his thoughts no it like a comments board. So in short they did go a little far on him with taking all the shit down they should have given like a notice to accuire the copyright from the creator before they took it down or just not done it at all they did go to far.But yeah firey you got it right.

I've read it (twice actually, since you don't use proper punctuation and misspell a lot). If you owned the rights to it I should be able to look up the rights within the copyright office. Which would prove that you own the rights to it.

Limewire, torrenting,etc,etc are all illegal methods of "sharing" content. Trying to justify your actions by saying that other people were doing it doesn't make you any less guilty.

The point is: You posted stuff you don't have the legal rights (if you did you could provide the papers/information required to prove that you have the rights to that product or that you had written permission from the creator of that content to post it on your blog. If you did, then we could look it up through the copyright office records. You didn't and they took it down. They didn't overstep their bounds, they stayed within their legal rights. Maybe they should have just asked you to remove the content like they did with Jacob but, you were probably didn't own the server you had "your" stuff on so they just contacted the people who hosted your site and just took it down.

Where did you have your blog (the site address or the hosting site address)? How much content did you illegally post? Did you own the sever that it was hosted on like Jacob & fakku (as in you bought a server and physically own that server and not just renting space)? Regardless if your "words" were there. You posted either images, pictures, art, music, videos,etc,etc,etc that somebody else created and that is what got you into trouble.

Just be thankful you weren't hit with a copyright infringement lawsuit.
