First, you repeat your initial assertion. And, I've already argued that the order addresses the school to prison pipeline...a set of administrative and societal norms that criminalize regular childlike behaviour---often because that behaviour is exhibited by a person of colour.
While it seems to be preferential treatment, it is actually a demand for fairness. If black kids were given the same "benefit of the doubt" treatment as whites, drop out and expulsion rates would plummet.
