It is just a drawing, and there's no way you can clearly tell the age of young adults in the real life to begin with. Seriously. I knew one guy who was convinced that I was 21 back when I was 16. So yeah.
It's also another example organizations/governments doing shit. Because, hey! It's better to chase something harmless and useless to us, than to tackle something really important right?
Same way how police in my home country once hunted pirated games users/pirates because "it was easier and safer than catching real criminals".

Age isn't absolute in anime unless its official characters. Appearance is something that people can manipulate very easily. Only the artist and someone with knowledge of the picture would be able to determine Age and Maturity. A very good example would be a Succubus.

Yup, OP's from Sweden. Actually, I've been reading up on this case that, probably, started the debate (Being a Swedish lolicon myself, I see it as my duty). The case is as follows:
A Swedish manga translator was sentenced to an about 30000 kr fine (That would make about $4200 or 3200 Euro) for the possession of 51 pictures of children or teenages in sexually provocative poses, all drawn. Now, as I've read, only about 5 of them were of "children" engaged in sexual intercourse, the rest was what would be considered softcore. I do belive he was sent to prison on parol, too, or something.
Reason? Well, apparely these pictures "infringe the integrity of children everywhere. And, according to the police, "A picture of a naked child is a documented abuse of a child". What child?
This concern me, a little bit. Seeing how I have way enough loli on this here harddrive to put me in jail for several months. Encryption ftw. Anyway, that's the case. The politicians are so bent on protecting the children, I think somewhere along the way, they forgot that this is actually about the children...

If it's realistic, then if an underage model was used, it might be considered illegal. Or so I'd imagine.
Some artists use their children as models in paintings and art photography, and though that flies for a while when they're toddlers or something, it later gets very much contended by the art world.

Depends on where youre from. Illegal for me though.
The debate seems to have died down here in Sweden,
but it was only the first instance, hopefully it will go to the high court.
That will be FUN. Hopefully they will give a more sensible judgement.

there are to many people that will make a bigger deal about it then it really is... if its a drawing then in my opinion its a victim less crime and they shouldnt bother but living in the usa if you go to court they will just look down at you and slap you will jail time... at the same time there a people getting off theft and stuff like that but thats just america

As for sweden we just need to vote for the pirate party on election day 19th september (which also happens to be talk like a pirate day). If we can enter the parliament these laws will go away quickly.

Ive heard the legal age of consent in japan is very low (15 or less in some prefectures?) so you could probably use that in your favor as well.

Im pretty sure it would have something to do with parental consent, since they would be giving up their child. When that a region determines you to be an 'adult', your free to marry whoever you want, but until then you need your parents to sign off on it.

To Give you an idea from a legal stand point, i dont know what country you are in but, My thought process dictates, that the only person who could actually state the age of said character would be, the artist (should it be an non series work, and the producers should it be a parodity of an anime videogame what ever) Even then because japanese does not translate to english anywhere near fluidly, its very possable for information to be badly translated, So really its near impossable and is purely subject to the person viewing the material to make the decision. I Can think of a few porn stars who if you diddnt know would sware appeared under 18 Kitty jung is the one that always seems to come to my mind... shes somewhere between here late 20's and early 30s (i believe) but due to being of small stature (5'2", i think yet again dont qoute me) And her chest being about as flat as it could be... when i first saw her, i though "how the hell did this make it into the open net" then after doing some research i found out.
So to give you a simple Responce, You Really can't Determine an actual age as these characters do not exist. It is purely subjected to the Viewing audiance, and in the case of lolicon, weather the legal system of your country wants to be pricks or not
