They can, but whether they lock your account down or not is another question. They've been enforcing their TOS as of late in regards to porn/hentai.

The tracker name has "august" in it. It's not August anymore, that's why it's an unregistered torrent pass. Just go to BakaBT, search the torrent again, save the url, log out, plug url in again, and re-download. You'll notice that the tracker name will now have "september" in it when you do.
