I think most of us here on Fakku will be safe as long as we stay out of trouble. Don't deal with real CP in the slightest (as if you have to be told that), don't molest little kids (again, don't need to be told that), and don't order stuff through the mail that contains lolicon of any sort. All the people convicted seem to have gotten stuff through the mail which somehow alerted the cops, and they had CP as well as lolicon, which got them in a buttload of trouble. And don't be a hacker or a prankster if you do any serious shit.
If the cops have no reason to suspect you of a serious crime, they're not going to just run into your home and search your computer.
just keep your microwave oven close to your hdd's and optical media

This got me thinking about the Kodomo no Jikan mangas. I remember they got licensed, then they got unlicensed because the the loli factor. It was taken as child porn and wasn't allowed to be licensed.
EDIT: http://www.mangavolume.com/index.php?serie=kodomo-no-jikan&chapter=kodomo-no-jikan-44&page_nr=21 <---Oh my, I guess that can be one reason the manga won't get licensed. That's from why the latest manga chapter, I think... http://www.mangavolume.com/index.php?serie=kodomo-no-jikan&chapter=kodomo-no-jikan-44&page_nr=24 <---That's just for shits and giggles.

Loli was never my cup of tea, but I still feel bad for the rest of you ;(
Agree. I have maybe 1 manga that quals as loli (juan gotoh), the rest I'm comfortable with, but it still sucks. Good thing Jlist sells books on learning Japanese!
And as ShaggyJebus said, keep a low profile and keep logical and don't get into actual CP.

I doubt the supreme court will rectify this since they are appointed to their positions based on how they look at things. If they support lolicon as artwork and protected the president will appoint someone else if he feels lolicon shouldn't be protected.
In short. Things in this country suck, they will continue to suck and they will get worse.
THIS SHIT MAKES ME WANNA KILL EVERYTHING.

Wait a minute...
Obscene? Was he sending them to people who didn't want them or was him and some other people just enjoying themselves? If he was just enjoying it how can you charge him with obscenety charges if there was no unwillngy party?
So are we protecting imaginary children now? Isn't the whole problem with pedaphiles is that they hurt REAL children? Now I can understand the concept of lolicon and such leading to becoming a pedaphile, Understand not agree, but the idea that lolicon is wrong because it hurts imaginery children? I must have misunderstood, that can't possibly be correct.
Clouding the issue further? Isn't this the real problem? Shouldn't we be trying to help the real children hurt by this offense and catching who took those photos rather then defending imaginary children? Once again I must have misunderstood.

Additionally, he was found to have sent and received incest related emails of a purely textual nature, which were judged to be obscene and therefore not constitutionally protected free speech. “It is not a required element of any offense under this section that the minor depicted actually exists.”

Clouding the issue further, the man apparently also received unambiguously illegal photographs of underage sexual conduct.

Socrates once said, "The law is the correct judgement of the state." In doing so he willingly signed his own death warrent. His idealogy was that though the laws may indeed be unjust, all men are bound by it. Such is the situation we are faced with. We may find the rulings detestable and biased, but we are powerless to do anything about it. And the world is all the darker for it. I do not agree that what the courts have done is just, nor do I condone their prejudicial rulings. However, one can understand the reasoning, however unsound and unfounded it may be, behind their rulings. It is the standard "It inspires people to do sick things to children vs. it offers a safe alternative to doing sick things to children" debate. While both claims are debatable, neither one is necessarily wrong. What the courts fail to deliberate is whether the benefits outweigh the risks. There is also the fact that nobody can say for sure if the artists use real models or not as a base for their artwork, much like David did for Michealangelo's sculpting. While the majority of the artists may be sensible enough to refrain from such things out of principle, there will always be some unscrupulous bastard out there that will ruin things for everybody. To them I say for shame. But for the legitimate artist, I say, hone your art, until it a thing of such beauty that not even the most foolish and closed-minded man may deny its splendor.

it took me a while to figure out what i wanted to say about this. its a very controversial subject: pedophilia is wrong in every way, but depicted in hentai its suddenly stripped of all its indecency. i can easily see why viewing loli is considered obscene when considering it is an act of moral looseness, but i think that anyone in their right mind can distinguish when sexual deviance crosses the line. the fact of the matter is that the felon had more then just loli in his possession... if anything he was using it as a cushion for his true intentions.
i guess what im trying to say is that its very hard to support the views of the pro-loli community. 'they aren't real!' and 'it isn't hurting anyone...' are good points, and im sure theres more then one reason that we view it. but without the mutual literacy most of us share when enjoying hentai it almost seems like having a motive without the intent to carry it out.
i am VERY, VERY pro hentai, i dont care what genre it is. it is simply the most popular and easily available way of enjoying the growing options of perverse ideas we could ever possibly have. be literate and know that none of it is real; i hope thats the primary reason you can enjoy it.
what do you think is pushing the boundries when it comes to hentai? is there a genre that will never appeal to you and why? discuss.

I'm not so much concerned about loli on my computer, only a couple mangas in my entire stash have loli/shota elements to them. What does concern me is the fact that the texts 'of an incestuous nature' were deemed obscene. Of course, I'll have to look-up the exact law, but isn't obscenity exposing unwilling parties to pornographic content? Because if you censor literotic materials, then what's next? [slipper slope argument].
Though if ASSTR has managed to go on this long without being thrown the book, myabe I've got not too much to worry about there?
